The North Carolina Judicial Branch says estate administration handles a deceased person's assets and debts, but land and houses often pass outside the probate estate unless a will says otherwise or a sale is needed to pay estate debts. That means “the house is in probate” does not answer who can sell it.
Before accepting any offer, ask a North Carolina attorney or the estate's Clerk of Superior Court what applies. An executor, administrator, surviving owner, or heirs may have different roles depending on the deed, will, court file, and family circumstances.
